Better ethics stem from a sense of right and wrong, good and bad, moral and immoral, which all come from a source, and in America, the source is the Bible. Even the laws of America were established in lock step with the principles of the Bible.

NFL Flashback: Saints Beat Vikings To Advance To Superbowl

Until Sunday, it looked as if the return of Brett Favre to the NFL would have a storybook ending and propel the Minnesota Vikings to the Superbowl. Instead, the New Orleans Saints will be heading to the Superbowl for the first time in franchise history. Garrett Hartley nailed a 40 yard field goal in overtime to give the Saints a 31-28 victory in the NFC Championship game after Brett Favre was intercepted deep in Saints territory during the final seconds of regulation.

The Vikings did reward NFL betting fans who took them as +4 underdogs with a pointspread cover. Minnesota finished the season a solid 11-6-1 against the NFL pointspread while the Saints head into the Superbowl with a 9-9 ATS mark. The 59 combined points scored went OVER the posted total of 53'.

After the game, head coach Sean Payton drew an analogy to the city of New Orleans' recovery after Hurricane Katrina:

"This is for everybody in this city. This stadium used to have holes in it and used to be wet. It's not wet anymore. This is for the city of New Orleans."

Winning quarterback Drew Brees extended that same metaphor:

Colts' QB Manning To Get Record Contract Extension

In what has to be one of the least difficult front office personnel decisions in sports history, Indianapolis Colts' owner Jim Irsay has confirmed that the team will sign quarterback Peyton Manning to a contract extension that could make him the highest paid player in NFL history. Manning's current deal will expire after the end of the 2010 season, with the final two years having been voided due to his meeting a number of performance based criteria. Despite losing the Superbowl this year, the Colts have not wavered on their commitment to Manning as the longterm QB for the team.

You can tell that an owner is adamant about resigning a player when he tells the media that he wants to make him the highest paid player in league history, and Irsay did just that at the NFL's Superbowl media day on Monday:

"You know it's going to get done. I think it's clear, and we'll start on it this summer. That's been the way we do things [to hammer out an extension when a player is entering the final year of his contract]. And it'll be the biggest [contract] in history; there's not much doubt about that."

Not exactly the most advantageous negotiating position to make public that you're committed to breaking the bank to resign a player. Then again, it's not like Manning is a quarterback that can easily be replaced as Irsay emphasized:

"It simply comes to one question, and that's replaceability. Everything is based on the replaceability factor. You make decisions based on who you can afford to target and keep. ... Other guys you really want to [re-sign] you might have trouble doing it, because of what it costs you, and how much attention they're getting [from other teams in free agency]. We don't have that luxury and we've had to work hard."

Manning's agent, Tom Condon, has already had preliminary discussions with the Colts' management about a new deal. Condon also represent's Peyton's brother Eli Manning, and negotiated a $97.5 million contract extension from the New York Giants for him last year. There are many different forms of laser cutting machine, with some running on gases and some using diodes to get the work done. Some of these lasers have been made strictly to cut non-melting materials (wood for example), and most are used to cut metals and plastics. They are categorized based on the energy and wavelength of the beam produced. For instance, they can have names such as "semi-conductor" lasers and "fluid" lasers, yet they all rely on the exact same basic principles.

So, how does the laser cutting process work? As the most common use of lasers is to cut heavy metals such as steel and stainless steel, the largest number of laser cutting machines will actually melt rather than cut the metal as it crosses the path of the beam. The beam is produced inside the device where atoms are manipulated in an extremely controlled way to produce a powerful stream of light that can be absorbed by the metal. This produces an extraordinary amount of heat by the beam that will melt the metal.

Interestingly enough, many laser cutters can make both clean and highly-finished or sealed cuts, but they could also make less refined cuts so as to allow other machinery to finish the modifications. For instance, if a laser cut metal component needs some form of threading worked into the design, the software can actually program the laser to avoid hardening the edges of the cut.

If a company focuses on laser cutting operations they will typically seek ways to boost efficiency. For example, some businesses will "nest" parts on their laser cutting machines, allowing them to create several objects with a single use of the laser. Some companies even choose to computerize their entire manufacturing process. This can have quite a few names, including CAM, MRP and ERP, but these are all separate technologies that can be combined to make the manufacturing process more efficient and economical. Such programs might receive instructions to create parts for three or four different jobs using the same kind of material. Instead of scheduling separate production runs, they will schedule all of the parts to be cut from the same sheet and in a single procedure. Ever wonder about the legality and ethics of referral fees between Ontario realtors (note: I use the term "realtors" throughout this blog to mean real estate sales representatives) and lawyers? Say, for example, your realtor recommends a lawyer to close your deal. If you end up going with that lawyer, is it legal and ethical for the lawyer to pay a referral fee to the realtor?

Conclusion: The bottom line is that referral fees are prohibited as between a realtor and a lawyer. While the issue of whether a realtor can make a referral fee may be somewhat unclear, the Real Estate Council of Ontario has made a strong case that such fees are prohibited. A realtor is, however, capable of receiving a referral fee from a third party provided that such fees are first disclosed by the third party to the client and the client agrees (preferably in writing). In such a case, the third party would pay the referral fee to the realtor's employer (i.e. the broker), who would in turn pay the realtor. Much like a realtor, however, a lawyer is not capable of making a referral fee to non-lawyers, but is capable of receiving such fees under the same conditions as would a realtor. Therefore, since neither a realtor nor a lawyer are capable of making referral fees (notwithstanding that they're capable of receiving them) to one another, referral fees are prohibited as between them. Breach of this rule is both illegal and unethical.

The following analysis shows how I came to these conclusions.

Realtors and so-called "Bird-Dog" or Referral Fees The combined effects of ss. 30(b) and (c) of the Real Estate Business and Brokers Act, 2002 provide that a broker shall not "pay any commission or other remuneration" to "employ or engage an unregistered person to trade in real estate".

Here, a number of terms require further clarification.

Section 1 defines a broker as "a person who, for another or others, for compensation, gain or reward or hope or promise thereof, either alone or through one or more officials or salespersons, trades in real estate, or a person who holds himself, herself or itself out as such".

Moreover, s. 1 defines a salesperson as "a person employed, appointed or authorized by a broker to trade in real estate". Here, the word "employ" means "to employ, appoint, authorize or otherwise arrange to have another person act on one's behalf, including as an independent contractor".

Finally, s. 1 defines a trade as including "a disposition or acquisition of or transaction in real estate by sale, purchase, agreement for sale, exchange, option, lease, rental or otherwise and any offer or attempt to list real estate for the purpose of such a disposition or transaction, and any act, advertisement, conduct or negotiation, directly or indirectly, in furtherance of any disposition, acquisition, transaction, offer or attempt, and the verb 'trade' has a corresponding meaning".

Clearly, while no broker may pay any form of compensation to unregistered persons in furtherance of a trade in real estate, it is somewhat unclear whether salespersons (i.e. realtors) are also prohibited from doing so (because salespersons are not mentioned in s. 30). As Allan Johnson, Registrar of the Real Estate Council of Ontario, mentioned in a now expired Registrar's Bulletin: "A question posed recently dealt with the salesperson and his or her right to pay some form of compensation in gratitude for leads provided. This issue may not be as clear." Interestingly, RECO's new Registrar's Bulletin on Bird-Dog fees states that, "where a brokerage is aware of, or more obviously where the brokerage were to use an employee/salesperson as a conduit to pay some form of compensation, in an attempt to avoid the appropriate sanctions of the Act, this activity would be construed to be a violation". So if a salesperson acted alone without the knowledge of the brokerage, would the latter be immune from liability? In the expired Registrar's Bulletin, Mr. Johnson suggested two caveats which would seem to prohibit salespersons from providing referral fees: "1. In light of the fact that salespersons are registered and employed by a specific broker and in fact act with the expressed authority of their broker employer, it may be argued that a salesperson's action in paying compensation with either before or after tax dollars, may in fact be tantamount to the broker breaching section [30(b)] and/or 2. Payment of this type of compensation to an unregistered person, for what could likely be defined as 'in furtherance of a trade', may very well put the salesperson in the position of 'counseling to commit an offence' wherein the person receiving the compensation is determined to be in contravention of the Act, by virtue of trading in real estate without benefit of registration. - 2364

6. Sixth on the list is a 1962 Volvo P1800 which caught worldwide attention in a British espionage TV series, The Saint, which aired from 1962 to 1969.

7. A 1957 Chevrolet bus became the most famous visual identity of another 1970's popular TV series, The Partridge Family, which ran for four years.

8. The 1972 Ferrari 365 GTS/4 was a pioneering Ferrari model that was popularized by the smashing police drama TV series, Miami Vice, which ran from 1984-89. Towards the latter years of the show, the car was replaced by a Ferrari Testarossas.

9. Also known as the muscle car, the 1970 Chevrolet Chevelle SS is another captivating vehicle that was driven by Matthew McConaughey in the movie, Dazed and Confused, which was released in 1993.

10. Of course, the people can't miss the 1959 Cadillac Miller-Meteor Ambulance named ""Ecto-1"" in the 1984 smash flick, the Ghostbusters.

Eskimos Outlast Stampeders In Wild CFL Matchup

The Edmonton Eskimos survived a wild back and forth CFL shootout against the Calgary Stampeders before prevailing 38-35 to take over sole possession of first place in the CFL West. Edmonton improved to 4-3 with the win, while Calgary dropped to 3-4.

Winning QB Ricky Ray said that he enjoyed playing in the shootout:

"That was a ton of fun. In the CFL you get to play in a lot of games like this, especially against a guy like (Calgary quarterback Henry) Burris, who has done this to us. It's great to come out on the winning end of a shoot-out like that. It's a great uplift for the team. It's a huge win for us."

With a bye week on deck, Eskimos head coach Richie Hall said that the win couldn't have come at a better time:

"Regardless of what happens, we are coming back in first place. Now we have one up on Calgary. It's going to be a dogfight for all the teams in the West and any chance you get to win, especially a win like this, it's a real bonus. It's great for our confidence."

Calgarys Burris remembered a very similar game last year:

"They got us last year in this situation and of course you didn't think it was going to happen again or even could happen again. It felt so great to get that late touchdown and with 38 seconds on the clock nobody was even thinking about last year. We had to stop Jackson and we didn't. And we had to stop Ray and we didn't. Kudos to Edmonton."

Calgary returns to action on Aug. 28 in Toronto while the Eskimos will next play on Aug. 29 when they host Hamilton. The two CFL provincial rivals from Alberta will face each other twice more this season. - 2364
